1. Do you believe that the Constitution
is the "supreme law of the land" and that the Bill of
Rights acknowledges our birthrights?
Yes, I believe it
documents and guarantees (some but not all of) our individual
rights.
2. If so, should these rights be pro-actively
protected from infringement by all levels of government, including
city, county and state?
Yes, this is called "incorporation of rights,"
I believe; and even if they won't protect these rights, we should be willing to protect them. Sadly, we may not be far away from a time where Americans will have to stand up and decided if they will continue to be free.
3. Please give some examples of gun laws you
consider constitutional.
The Castle Doctrine, and Open Carry,
which is technically a lack of a law. "Shall not be
infringed" is pretty strict...
4. Please give some
examples of gun laws you consider unconstitutional.
The Brady
Act, the 94-"Assault" Weapons Ban, Hi-Cap Mag bans,
licenses to own or carry. The GCA of '68, the NFA Act of '34, along with many others.
5.
Does the right to bear arms include the right for any peaceable
citizen to carry them concealed without a permit, as in
Vermont?
Yes.
6. Do you believe that
Americans have a right to own, use and carry weapons of military
pattern, and will you use the prestige of elected office to publicly
promote that right?
Yes. I believe that the most
'restrictive' interpretation of 2A would mean that the citizens, at
the very least, should have access to the same weapons the average
infantryman has access too. A well-trained and prepared
Militia, and all that. However, my reading of it is more lenient than that.
7. Do you support or oppose
registration of weapons? Why?
I strongly oppose registration of
arms. Confiscation or banning of weapons has always been
preceded by registration. "Shall not be infringed" is
pretty clear to me. In the 20th centry, nearly every major genocide from the Armenian Genocide to the Holocaust, have been preceded by a registering and than a ban of privately owned weapons of those groups who were murdered.
8. Do you support or oppose licensing
requirements to own or carry firearms?
Why?
I oppose
licenses to own and carry firearms. A man with arms is a
Citizen, one without is a serf. If you have to ask
permission to exercise a right, it's not a right: it's a privilege;
and privileges can be taken away.
9. What specific gun laws
will you work to get repealed?
The anti-carry laws in
Charleston and Dunbar, the registration process for CC; I would work
towards a permit for reciprocity with other States, but I would seek
to recognize our rights to carry concealed (just as we can openly, in
WV) without a permit. I would work towards a version of the Montant Firearms Freedom Act, a nullificaiton of the GCA, the NFA, and the Brady Act.
10. If elected, will you back your
words of support for firearms rights up with consistent actions?
How?
I am a gun owner. I open carry. I'm a firearms
instructor-in-training. I will always vote for the
Constitution, and for the people.
